FACT CHECK: ICC has not ruled that Duterte can return with a tracker

FALSE. A Facebook post claims that the International Criminal Court (ICC) has ruled that former President Rodrigo Duterte may return to the Philippines as long as he wears a location tracker.

FACT. There is no such ruling. Official ICC records show that no tracker‑based return order exists on the court’s docket.

No official decision, press release, or court document from the ICC indicates any conditional return of Duterte with a tracker. Posts circulating on social media claiming this have no supporting evidence from the court’s official channels.

Duterte has been formally charged by ICC prosecutors with multiple counts of murder and attempted murder as crimes against humanity. These include the killings of 19 individuals in Davao City, 14 “high-value targets” nationwide, and 45 victims during barangay clearance operations. The charges allege his role in organizing anti-crime operations, abetting impunity, and arming and incentivizing personnel.

Regarding his judicial status, Duterte remains detained in The Hague. The ICC Pre-Trial Chamber found him fit to participate in proceedings as of January 2026.
