Kailan ba dapat nagkakaroon ng remote sessions ang Senado?

Muling naging usapin ang paggamit ng online participation sa Senado matapos tutulan ng Minority Bloc ang mungkahi ni Sen. Rodante Marcoleta na pahintulutan ang mga senador na makadalo sa sessions sa pamamagitan ng online platforms, kagaya ng Zoom.

Sa kabila nito, pinanindigan ni Sen. Robin Padilla ang paggamit ng virtual participation sa Senado.

“Matagal nang tinatanggap sa pamahalaan ang Zoom para sa mga pagdinig, pagpupulong, at proseso,” ani Padilla.

Ngunit batay sa umiiral na rules ng Senado, may limitasyon ang paggamit ng remote participation sa mga opisyal na sesyon.

Sa ilalim ng Section 41 ng Rule XIV ng Rules of the Senate, pinapayagan lamang ang remote o teleconference participation sa mga sitwasyong may force majeure o national emergency na nagiging hadlang upang personal na makadalo ang mga senador sa session hall.

Sa madaling salita, hindi ito itinuturing na regular o pangkalahatang sistema para sa lahat ng senador sa ordinaryong plenary sessions.

Hindi naman ganap na bago ang remote participation sa Senado. Noong kasagsagan ng COVID-19 pandemic, pansamantalang inilipat online ang ilang Senate proceedings upang maiwasan ang pagkalat ng virus at mapanatili ang operasyon ng lehislatura kahit may health restrictions.

Noong kasagsagan ng COVID-19 pandemic, pansamantalang inilipat online ang ilang Senate proceedings dahil sa health crisis. Inaprubahan ng Senado ang Senate Resolution No. 372, kung saan pinahihintulutan na ang pagsasagawa ng plenary sessions at committee hearings sa pamamagitan ng teleconference, video conference, o iba pang maaasahang remote o electronic means.

Inamyendahan nito ang Section 41 ng Rules of the Senate patungkol sa pagsasagawa ng plenary sessions at committee hearings gamit ang remote o electronic participation.

Subalit bago pa man ang pandemya, minsan na ring naging paksa ang remote participation sa Senado kaugnay ng kaso ni dating Sen. Leila de Lima.

Noong 2018, naghain sina Sen. Ping Lacson at noo’y Sen. Franklin Drilon ng Senate Resolution No. 51 upang payagan si De Lima na makalahok sa plenary debates at committee hearings sa pamamagitan ng teleconferencing, videoconferencing, o iba pang remote communication habang siya ay nakakulong.

Batay sa resolusyon na si De Lima, nananatili pa rin ang kaniyang constitutional rights at civil at political rights bilang halal na senador. Gayunman, hindi rin nagtagumpay ang naturang panukala.

Sa gitna ng debate, nananatiling sentro ng usapin kung hanggang saan dapat pahintulutan ang online participation sa Senado, at kung ito ba ay dapat manatiling limitado, partikular na dahil sa kasalukuyang lagay ng political landscape ng Pilipinas kung saan ilan sa mga Senador ang humaharap sa mga kaso, kabilang na rito sina Sen. Bato Dela Rosa, Sen. Jinggoy Estrada, at Sen. Rodante Marcoleta.
