FALSE. A Facebook post claims that the Supreme Court of the Philippines ordered the expulsion of Bienvenido Abante Jr. from the House of Representatives.
FACT. There is no Supreme Court ruling expelling Abante, and he remains the duly elected representative of Manila’s 6th District.
No official decision, resolution, or order from the Supreme Court confirms his removal from Congress. The official House of Redpresentatives website continues to list him as an active member, and he has recently participated in legislative actions, including endorsing the fourth impeachment complaint against Vice President Sara Duterte.
Under Article VI, Section 16 of the 1987 Philippine Constitution, the House of Representatives has the exclusive authority to discipline, suspend, or expel its members, which requires a two-thirds vote. The Supreme Court does not have the power to directly remove a sitting lawmaker from office.
While the Supreme Court may exercise judicial review, it can only determine whether an expulsion process violates the Constitution. It cannot initiate or enforce the removal of a member of Congress.
